McKinney Vento

McKinney-Vento is the primary piece of federal legislation dealing with the education of children and youth experiencing homelessness in U.S. Public Schools. Homelessness is the lack of a fixed, regular, and adequate nighttime residence. Students experiencing homelessness are eligible for the protections and services the Mckinney-Vento Act provides to increase educational stability and remove barriers to school enrollment. It was reauthorized as Title I, Part A, of the Every Student Succeeds Act (ESSA) in 2015.

Who is homeless?

  • are sharing the housing of other persons due to loss of housing, economic hardship, or a similar reason;
  • are living in motels, hotels, trailer parks, or camping grounds due to the lack of alternative adequate accommodations;
  • are living in emergency or transitional shelters;
  • are abandoned in hospitals;
  • are awaiting foster placement;
  • have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings;
  • are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings; and
  • migratory children living in the circumstances previously described.

Each school district must appoint a local homeless education liaison responsible for the identification, school enrollment, attendance, and opportunities for academic success of students experiencing homelessness.
